Terms and Conditions for Tian Villa Holiday Rental

 

These terms and conditions (the "Agreement") govern the use and rental of the villa ("property") by the holidaymaker ("guest"). By making a booking with us, you agree to comply with and be bound by the following terms and conditions:

 

1. Booking and Payment:
a. To secure a booking, a security deposit of 250€ is required
b. The full balance must be paid a minimum of 45 days prior to your arrival.
c. In the event of a last-minute booking (within 45 days of arrival), the full rental amount and deposit must be paid at the time of booking.

d. Bookings have to be made with a minimum of 4 days notice.

e. Minimum stay 3 nights. Maximum stay 184 nights

 

2. Cancellation Policy:
a. Full refund will be provided for cancellations made more than 45 days before your arrival.
b. Cancellations made within 45 days of the arrival date will result in the loss of the full rental amount and security deposit or amount already payed.

 

3. Maximum Occupancy:
a. The maximum number of guests allowed to stay at the property is 6 + 1 under age of 2.
b. Guests exceeding the maximum allowed occupancy will be subject to additional charges or asked to vacate the property immediately.

4. Security Deposit:
a. A security deposit of 250€ (payable when securing your booking) is required to cover any damage, loss, or breakages during your stay.
b. The security deposit will be refunded in full within 2 days after your departure, provided that the villa is left undamaged and in the same condition as it was upon your arrival.
d. Any deductions from the security deposit will be made to cover the cost of damages, loss, or breakages caused during your stay. We will provide an itemised list of deductions, along with receipts and invoices to support these charges.

 

5. Property Use and Conduct:
a. The property is to be used for residential purposes only and not for any commercial or social events without prior written approval.
b. Guests must behave responsibly, respectfully, and in compliance with local laws and regulations.
c. Noise levels must be kept to a minimum between 10PM and 7AM to avoid disturbing neighbours.
d. Pets are not allowed unless specified in writing.
e. Smoking is strictly prohibited inside the property.

f. Swimming pool is heated to 28 degrees celsius  

g. Owners and housekeepers are not responsible for any injury caused at the property

h. Please use caution when the swimming pool is covered as it can be very dangerous. Do not attempt to use the swimming pool while covered. 
i. Use of swimming pool is only for comfortable swimmers. 
j. Children under the age of 18 must be supervised by a parent or guardian at all times. 

k. Quiet time during spanish siesta and at night between 10PM and 7AM

6. Guests:
a. The villa is rented only for family vacations or for groups of adults over the age of 21.
b. Bookings cannot be accepted from anyone under the age of 21.
c. Hen or stag parties are not allowed under any circumstances.
d. This villa is located in a peaceful residential area; therefore, parties, loud music or any other activities that may disturb the neighbours are strictly prohibited.
e. The property owner reserves the right to ask any guests to vacate the property if they are found engaging in activities which are illegal, immoral, or disruptive to the neighbourhood. In such cases, no refund will be given.

7. Utilities:
a. The owner of the villa shall not be held responsible for any failure of the utilities provided, such as electricity, water or internet. 
b. In case of any such failure, the owner will try to assist as soon as possible to resolve the issue; however, no refund will be given for such failures.
c. Guests are responsible for their own personal items and valuables and the owner of the villa shall not be held liable for any loss, damage, or theft during the stay. It is recommended that guests obtain traveler's insurance to cover any such losses.

 

8. Liability and Insurance:
a. We cannot be held responsible for any injury, loss, or damage to guests' personal belongings or vehicles during their stay.
b. Guests are advised to obtain comprehensive travel insurance to cover any potential accidents, cancellations, or unforeseen events.

 

9. Check-in and Check-out:
a. Check-in time is between 3PM and 10PM, and check-out time is before 10AM.
b. Unless otherwise agreed in writing, failure to vacate the property by the agreed check-out time may result in additional charges.

10. Force Majeure:
a. We, the owner and the owner's key-holder, will not be liable for any loss, injury, or delay occasioned by any of the following events beyond our control: strikes, riots, political unrest, hostilities, war, or threat of war, terrorist activity, industrial disputes, fire, flood, technical and/or weather problems with transport, aircraft grounding, flight cancellations, airline collapse, closure of ports, or airports, government action, civil emergency, epidemic, pandemic, weather conditions, acts of nature, acts of God, or any other event beyond our control and that of the owner's key holder.

 

11. Maintenance and Repairs:
a. The guest shall notify us promptly of any malfunctions, defects, or damages to the property.
b. Reasonable access must be granted to carry out repairs or maintenance if necessary.

 

12. Termination:
a. We reserve the right to terminate this Agreement and ask guests to vacate the property immediately if they breach any of the terms and conditions herein.

13. Guest Obligations:
a. Guests are expected to take good care of the property and its contents during their stay. They are also expected to comply with any rules and regulations provided in the Welcome Booklet and any other reasonable instructions given by the owner or the owner's key-holder. 

b. Guests shall be responsible for any damages caused to the property or its contents during their stay, whether caused by themselves or their invitees. Any damages must be reported to the owner or the owner's key-holder immediately.

c. Guests must ensure that the bbq is left in a clean and tidy condition and rubbish is taken out upon departure . Failure to do so may result in additional cleaning charges.

d. Guests must use the property for lawful purposes only and not disrupt the peace or infringe upon the rights of the neighbours or other third parties.

e. Guests shall not sublet or assign the property or any part of it without the prior written consent of the owner or the owner's key-holder.

f. The maximum number of guests allowed to stay in the property shall not exceed the number stated under section 6, unless agreed in writing with the owner or the owner's key-holder.

g. Guests are responsible for their personal belongings. The owner and the owner's key-holder shall not be liable for any loss, theft or damage to such belongings.

h. Guests shall fully indemnify and hold harmless the owner and the owner's key-holder against any claims, damages, losses or expenses arising from their breach of these terms and conditions, except to the extent such claims, damages, losses or expenses are caused by the owner or the owner's key-holder.

 

14. Governing Law:
a. This Agreement shall be governed by and construed in accordance with the applicable laws of Alicante - Spain.
